For clients who have entered into a separate License Agreement for the CardOpz Platform, that agreement governs the commercial relationship, service levels, and platform-specific terms. However, these Terms of Service, including the SMS/Text Messaging Terms, apply to all properties listed above regardless of any License Agreement.

CardOpz.com is committed to complying with applicable laws and regulations, including but not limited to the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR). We ensure that any personal data collected through this website is handled in accordance with these regulations.

CardOpz provides SMS messaging services for two distinct user groups with different purposes and consent processes:

1. Business Staff Authentication (cardopz.app)

When staff members access the CardOpz management platform at cardopz.app, they may receive:

• One-time login links for passwordless authentication
• Two-factor authentication (2FA) codes
• Security alerts about account access
• Critical platform updates

Staff Consent Process:

• Mobile numbers are provided during on-site account creation by facility managers with employee consent
• Staff confirm consent when claiming their account at cardopz.app
• Each login request requires clicking "Send login link" with clear consent notice

2. Member Portal Notifications ([clientname].cardopz.com)

Members accessing client portals at [clientname].cardopz.com may receive:

• Login verification codes for portal access
• Notifications when messages are waiting in their account
• Email/phone verification codes
• Account security alerts

Member Consent Process:

• Initial consent provided during on-site enrollment at client facilities
• Secondary consent required when first accessing portal online
• Members must actively request SMS verification and see consent notice
• Preferences can be managed in account settings

General SMS Terms for All Users

Message Frequency and Charges:

• Staff: One message per login request
• Members: Varies based on account activity (typically 1-10 messages/month)
• Standard message and data rates may apply per your carrier

Managing Your SMS Preferences:

• Opt-Out: Reply STOP to any message to unsubscribe
• Help: Reply HELP for assistance or email support@cardopz.com
• Re-enable: Contact support or update settings in your account

Your Consent Acknowledgments:

By providing your mobile number and opting in to SMS:

• You certify you are the authorized user of that number
• You explicitly consent to receive messages based on your user type
• You understand messages are for security and account management only
• You acknowledge that consent is logged for compliance purposes

Privacy and Security

• We use Twilio as our SMS service provider

Governing Law

Any legal action or proceeding arising under these Terms of Service will be brought exclusively in the federal or state courts located in San Diego, California, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
